Marshall Resident Released from ICE After Judge Rules Detention Was Unlawful

Marshall resident Aditya Harsono has been released from federal immigration custody after a judge ruled his detention violated constitutional rights.

Harsono, originally from Indonesia, had been held for nearly two months before U.S. District Judge Katherine Menendez ordered his release, citing a violation of his First Amendment rights.

Harsono was arrested by ICE on March 27 at his workplace, allegedly for overstaying his visa.

However, court records showed his student visa and work authorization were still valid at the time. He had been legally studying and working under the F-1 visa and Optional Practical Training (OPT) program.

His visa had been revoked based on a 2022 misdemeanor conviction for vandalism. The court found the offense posed no ongoing threat and noted that Harsono had reentered the U.S. without issue in 2024.

ICE also referenced a dismissed protest-related charge from 2021 as part of its justification for his detention, which the judge ruled suggested political targeting based on protected speech.

Harsono is married to a U.S. citizen, with whom he has a young daughter. His I-130 petition was approved on May 9, and a green card application is pending.

Although an immigration judge had granted bond, the Department of Homeland Security had blocked his release until the federal court intervened.

His release follows another Minnesota case where a foreign student was detained under similar circumstances and later freed by court order.

Marshall Mobilizes Legal Response to Noncompliance at Broadmoor Valley

The Marshall City Council has authorized legal steps against the owners of the Broadmoor Valley mobile home park over ongoing city code violations.

During a council meeting this week, city attorney Pam Whitmore reported that multiple complaints from residents have prompted the city to explore enforcement measures.

The complaints include a locked gate at one of only two access points to the park — a potential violation of zoning regulations, which require at least two entrances to a public right of way.

Previous attempts by the city to resolve the matter directly with the park’s ownership, Schierholz & Associates, have been unsuccessful. City officials have also been denied access to the property to investigate complaints.

Correspondence included in council documents showed that the city notified the owners in late March of the gate issue and imposed a $100 daily civil penalty starting April 7 after the problem was not addressed by the deadline.

In response, the park’s ownership claimed that state law limits access to their private property and characterized the city’s enforcement efforts as government overreach.

They also stated that only emergency personnel or health inspectors are permitted on-site without resident accompaniment, and that the homes are federally regulated, not subject to local or state oversight.

Although council members did not publicly discuss specific legal strategies during the meeting, they voted to allow the law firm Kennedy & Graven to pursue enforcement action in court to bring the property into compliance.
