Attorney General’s Lawsuit Against Mobile Home Park Heads to Court

A lawsuit involving the owners of Broadmoor Valley mobile home park is set to begin later this month in Lyon County District Court.

Filed by the Minnesota Attorney General’s Office in 2021, the suit accuses Schierholz and Associates of neglecting park maintenance, imposing excessive late fees for rent, and retaliating against residents.

On Friday, attorneys from both sides met with Judge Tricia Zimmer to prepare for trial and address issues related to evidence and witnesses. The court has allocated 11 days for a jury trial, scheduled from January 21 through February 4.

Deadlines were also set for the parties to submit additional written materials ahead of the trial.

While trial preparations are underway, settlement discussions remain active, leaving room for a potential resolution before the trial begins.

The future of Broadmoor Valley adds another layer of uncertainty to the case. In November, the city of Marshall and residents were notified of plans to close the mobile home park in December 2025.

According to Schierholz and Associates, the decision stemmed from the high costs of infrastructure updates required to maintain the property.

In compliance with state law, the city will hold a public hearing on the proposed closure. The hearing is scheduled for February 18 at Marshall Middle School.

Windom Police Provide Update on New Year’s Eve Tragedy

The Windom Police Department released additional details Friday regarding the fatal stabbing incident at the Phat Pheasant Pub on New Year’s Eve.

Authorities have arrested an individual, identified only as “No Name Given Happy”, who faces multiple charges, including second-degree murder with and without intent, second-degree assault with a dangerous weapon, and threats of violence.

The victim of the fatal stabbing has been identified as 30-year-old Ben Matter of Windom.

A 31-year-old male victim sustained non-life-threatening injuries and received treatment at Windom Area Hospital.

During the investigation, it was revealed that another 30-year-old man from Windom was also stabbed. He suffered minor injuries, was treated at the hospital, and later released.

The investigation remains active and is being conducted by the Windom Police Department in collaboration with the Minnesota Bureau of Criminal Apprehension.
